What is a soil disposal permit

A soil disposal permit is for the disposal of soil material at a Class 1, 2 or 3 landfill for soil material that includes silt, sands, clay and may contain some gravel. A Class 1 landfill accepts hazardous material as defined by the local governing regulations. A Class 2 landfill accepts both clean and impacted soil material as defined by the local governing regulations. A soil disposal permit requires an application to be submitted and approved by the landfill, containing details about the origin of the soil, representative soil analysis and information about the person or company applying for the disposal permit.

 

A soil disposal permit can be obtained for clean, impacted or hazardous soil material. A soil disposal permit allows for the documented transfer of soil material from your land to the landfill where the landfill takes on all liability for the soil material, which is critical when dealing with any impacted or hazardous material.

 

A soil disposal permit is generally NOT for loam, gravels and/or rock materials, which do not contain sand, silts, or clay materials.

Why do I need a soil disposal permit

Required By Governing Regulations

You are required by your local governing regulations to dispose of impacted or hazardous materials at approved Class 1 or 2 landfill. Depending on the jurisdiction that you are in, you may require permitting or soil characterization, just to transport soil material.

Required By Landfill

All landfills will require a soil permit disposal application to be submitted, reviewed and approval, prior to being disposed. A landfill application will also includes soil analytical data (less than 1 year old).

Liability

Impacted or hazardous soil material is a liability and once disposed at a Class 1 or 2 landfill, the land fill accepts responsibility/liability for the soil material. If you were to transport impacted or hazardous soil material to a third-party site, you could be fined by your local governing body (or receive jail time), sued by the third-party site, liable for cleanup of third-party site, which would include removal and proper disposal of the impacted or hazardous soil material at a Class 1 or 2 landfill.

Documentation

Disposing of soil material at a landfill provides you documentation, which may be requested by your governing regulatory body that that the soil material from your property/project/other was properly disposal.
